1. Service provider

Burgaz.bg is a real-estate listings platform provided by SMARTIA OOD (СМАРТИЯ ООД) · Burgas, Bulgaristan (AB). Contact details are on the Contact page. By using the site you accept these terms.

2. The platform's limits — what we do not do

Burgaz.bg is a listing publication medium: listings are published, seekers filter and find them, and leave an enquiry for the property they are interested in. In this respect, the platform acts as an intermediary service provider with regard to listing content.

By contrast, Burgaz.bg does not provide real-estate brokerage or real-estate consultancy services: it does not market properties, does not conclude contracts between parties, does not conduct negotiations, does not collect deposits/down payments or sale prices, and takes no commission. Purchase, sale and rental contracts are concluded directly between the parties; the platform is not a party to these contracts.

3. Accuracy of listing information

Information in listings such as price, area, number of rooms, floor, year of construction, energy class and location is based on the declarations of the party placing the listing. This information is not a binding offer and may change; typographical errors, outdated records or properties that have already been sold/rented are possible.

For this reason, before taking any binding step regarding a property — including the title/ownership status, zoning and use permits, debts and encumbrances, actual measurements and taxes payable — it is essential that you carry out your own review and, where necessary, obtain advice from a lawyer, surveyor or notary. The platform does not substitute for this review.

4. User content — rules

On Burgaz.bg, you publish the content: the listing title, description and photos, and the message you write into the enquiry form. You are responsible for every piece of content you publish, and you may use it only for a genuine real-estate listing or enquiry. The following are prohibited:

Insults, threats, harassment, discrimination, hate speech or sexual content; any kind of unlawful expression
Fake listings, publishing a property that does not exist or that you are not authorised to list, using a fake identity or fake contact details
Fraud, advance-payment/deposit traps or misleading prices
Sending advertising, mass promotion, chain messages or irrelevant content
Publishing another person's photo, text or personal data without permission
Submitting content with automated tools (bots, scripts, bulk submission) or attempting to exceed the request limit
Collecting listing data with automated tools (scraping), copying it or republishing it elsewhere

The text you submit passes through an automatic content filter before publication; content caught by the filter is not saved.

5. Zero tolerance, reporting, blocking and 24 hours

We have zero tolerance for objectionable content and abusive users.

Reporting: every listing page has a "Report content" menu; you can report content you consider against the rules from there. You can also send the same report via the channel on the Contact page.
Blocking: you can block a user; the listings of the person you blocked are never shown to you again.
24-hour commitment: reported content is reviewed within 24 hours at the latest. Where a report is upheld, the content is removed from publication and the violating user's account is closed; the person is removed from the platform.

If you believe a listing is unlawful, misleading or infringes your rights — including copyright, personality rights or wrong/incomplete information — sending your report together with the listing number speeds up the review. Where a report is upheld, the listing is corrected or removed from publication and you are informed of the outcome.

6. Intellectual property

The site's design, interface texts, classification structure and the compiled listing database belong to the service provider and are protected under the Bulgarian Copyright and Related Rights Act (ЗАПСП), EU Directives 2001/29/EC and 96/9/EC (databases), and Turkish Law No. 5846 on Intellectual and Artistic Works. The rights in listing images and descriptions belong to the party placing the listing.

7. Availability and changes

The service is provided "as is"; uninterrupted operation is not warranted. Outages due to maintenance, technical failure or providers may occur. Listings and site features may be changed or removed without prior notice.

These terms may be updated; the text in force is always the text published on this page. A material change will be indicated at the top of the page.

8. Liability

The platform is not liable — to the extent permitted by law — for the accuracy of listing content or for damages arising from the relationship between the parties. Cases of intent and gross negligence, and mandatory provisions on consumer protection, remain reserved.

9. Fees

There are no paid features in this version. The site is free of charge; no payment or payment details are requested from you and no commission is taken. If a paid feature is added, this text will be updated before it goes into effect.

10. Personal data

Which data is processed on which legal basis, the retention criteria, cookies and your rights are explained in the Privacy Policy and the KVKK Information Notice. This text contains no separate undertaking regarding personal data.

11. Governing law

These terms are governed by the law of the Republic of Bulgaria. If you act as a consumer, your right to benefit from the protection afforded to you by the mandatory consumer provisions of the country where you reside remains reserved, and you may apply to the courts of your own country.
